West Yorkshire Edition (Updated for 2026)

Under the Digital Markets, Competition and Consumers Act 2024, certain "Material Information" must be disclosed before a property is even marketed. Part C covers specific issues that only apply to some properties but could be a "deal-breaker" for a buyer.

Complete this checklist to identify any "Part C" traps before they delay your sale.


1. Building Safety & Construction

  • [ ] Non-Standard Construction: Is the property built of anything other than standard brick/stone with a slate/tile roof? (e.g., Timber frame, prefabricated concrete, or "Wattle and Daub" in older West Yorks cottages).

  • [ ] Cladding: If your property is in a high-rise block, do you have an EWS1 form or an up-to-date fire safety report regarding cladding?

  • [ ] Known Defects: Are you aware of any structural issues, such as historical subsidence, dry rot, or the presence of Asbestos (common in Artex ceilings)?

2. Restrictions & Rights of Way

  • [ ] Restrictive Covenants: Does your deed contain rules on what you cannot do? (Common in Leeds: No commercial vans on driveways, no business use, or no holiday letting/Airbnb).

  • [ ] Shared Access: Do you share a driveway or "snicket" with a neighbour? Who is responsible for the maintenance?

  • [ ] Public Rights of Way: Does a public footpath or bridleway cross any part of your land?

  • [ ] Conservation Area / Listed Status: Is the property a Listed Building or located in a Conservation Area (e.g., Saltaire, parts of Chapel Allerton)?

3. Environmental Risks

  • [ ] Flood History: Has the property (or the garden/cellar) flooded in the last 5 years? (Even if it was "just a bit of water" from a burst river or surface water).

  • [ ] Flood Defences: Are there any flood defences on the property, such as flood gates or a sump pump?

  • [ ] Coalfield Area: Is the property in a known mining area? (We can check this for you, but let us know if you’ve ever had a mining survey done).

4. Planning & Proposals

  • [ ] Outstanding Permissions: Do you have any active planning permissions for extensions that haven't been started yet?

  • [ ] Nearby Developments: Are you aware of any major planning proposals nearby (e.g., a new housing estate or the West Yorkshire Mass Transit/Tram lines)?

  • [ ] Unauthorised Work: Have you made any changes (loft conversion, removal of a chimney breast) without building regulations or planning approval?

5. Accessibility & Adaptations

  • [ ] Level Access: Does the property have step-free access from the street?

  • [ ] Internal Adaptations: Has the home been adapted with wet rooms, stairlifts, or widened doors that would be material to a buyer with mobility needs?
